										<content:encoded><![CDATA[<p>The survivor community lost a shining star recently with the <a href="https://www.legacy.com/obituaries/name/karin-huffer-obituary?pid=190658390" target="_blank" rel="nofollow noopener noreferrer">passing of Karin Huffer</a>, who wrote <a href="https://www.amazon.com/exec/obidos/ASIN/B079QPFGL1/ref=nosim/ lovefraud-20" target="_blank" rel="nofollow noopener noreferrer"><em>Legal Abuse Syndrome: A preventable public health problem. </em></a>She also pioneered the use of the Americans with Disabilities Act to help people dealing with sociopaths, narcissists and psychopaths get a fair hearing in court.</p>
<p>Through her consulting practice, Karin personally accompanied her clients to court to help them stand up against manipulative sociopaths, whom she called “power centered individuals.” Despite the fact that she was a very senior citizen and needed a walker to get around, she was absolutely indomitable in court, protecting her clients against lies, smear campaigns, and power plays from the opposing parties.</p>
<p>But one person can only do so much, and Karin realized that. She also founded Equal Access Advocates so she could teach other people to do what she did — become legal advocates for people with disabilities, including post-traumatic stress disorder. She offered the training online through the John Jay College of Criminal Justice, part of the City University of New York in Manhattan.</p>
<p>Karin offered webinars on Lovefraud Continuing Education explaining how to go to court against an abuser, and how to take advantage of the protections afforded by the Americans with Disabilities Act.</p>

A school year contains about 180 days of school; most children go to school for 12 years, which means that the pledge is uttered some 2,160 times, not counting preschool, college, sport events, and special occasions.</p>

<p>When something is repeated over and over, we start to believe it, i.e. that indeed, justice is for all.</p>

<p>As a marriage and family therapist with over 30 years of experience, Dr. Karin Huffer identified that extreme stress caused by our adversarial courts of law exacerbates health problems and can even cause PTSD and anxiety disorders. In response, she developed a 8-step protocol tackling prevention and recovery of Legal Abuse Syndrome. &#8220;Legal Abuse Syndrome (LAS) is a psychic injury, not a mental illness &#8211; a personal injury that develops in individuals feeling hopeless due to being ineffectual in the courts.&#8221; Dr. Huffer walks us through ways to combat Legal Abuse Syndrome.</p>

<p>Courts cannot see invisible disabilities unless ADAAA is used. Too often opposition cruelly and unlawfully accuses those with qualifying disabilities, i.e .PTSD, TBI, depression, of being “crazy” and lying as part of a ploy. The court does not know UNLESS WE TELL THEM that for access and inclusion the PWD, person with a disability, must invoke rights to privacy, equal access, and safety under the ADAAA federal mandates.</p>

										<content:encoded><![CDATA[<p><strong>THE PROBLEM  &#8211; DOMESTIC VIOLENCE AND NEED FOR ADAAA PROTECTION</strong></p>

<h3><span style="font-weight: 400;">From an anonymous victim in a shelter involved in court</span></h3>
<p><span style="font-weight: 400;">When anyone says the words “domestic violence’, I question if their reality matches mine. Was their abuser worse, stronger, louder?  I’m sure we all think our situation was..was..the most violent.  Being the brunt of his terror was the price I paid to protect my children from most of his direct physical attacks.  The alcohol fueled verbal ranting, yelling…calling out our names as he charged down the hall…, we knew he was coming to find us to smack and punch at will.  We, my kids and I, are out of that house…no longer at the end of the hall.  Our physical scars, a broken nose for me and my daughter, both my arms are deformed, my skin bears scars mostly on my face, back, and legs.  My daughter’s broken nose has been straighten, but mine, mine is my badge that proves I’m a survivor…of what some must wonder.  We hide, my children and I.  We hide.  We must look like rats skittering in the shadows of block walls and closed store fronts.  </span></p>
<p><span style="font-weight: 400;">We want to be free of the monster…my sweetheart, daddy.  None of us wants him in our lives.  I’m in court almost monthly answering filings and being subjected to psychological evaluations, me, not him, me!  I know I’ve hardened as I can’t cry anymore.  Tears are gone, a luxury of when I actually had feelings to hurt, the past.  Rage, red hot, is the new me.  I’m being attacked by the court now.  I relive the terror of the violence we endured and then I am attacked again by the lawyers and guardian ad litem that pick and pick like vultures at my scars.  I rage at them and at the imperfect justice system I was so sure would…see…they would see the truth.  If I don’t’ get help, real help, I’m going to lose the kids to him…the monster.</span></p>
<p>&nbsp;</p>
<h4><b>I NEED TO IMPACT THE COURT TO PROTECT ME AND THE CHILDREN</b></h4>
<p><span style="font-weight: 400;">Strangely, when Congress enacted the ADAAA in 2008, and now with the new regulations of October 2016, they did not envision the impact it would have on cases of abuse.  No abuse occurs like that described above without creating diagnosable trauma.  While the Americans with Disabilities Act Amendments Act or ADAAA does not include domestic violence it does cover the resulting traumatic injuries, mental or physical.  Because there is bias regarding disability in this nation and lack of training in the ADAAA and its updates, it is not used as intended to protect victims of violence.  They fear and say,</span></p>
<p><i><span style="font-weight: 400;">Disabled? Who me?  My mental or physical disability splayed before ‘the monster’ and his blanking henchmen lawyers?  That will ruin everything—I can’t look weak period I must prove that I can care for the kids.  My counsel agrees that using the ADAAA is a poor idea.   </span></i></p>
<p><span style="font-weight: 400;">As survivors wash up on the shore of the courthouses so sure of the life raft and safety they seek, they are finding real relief in the ADAAA from the compounding abusive tactics of the adversarial system.  Most of us have no idea what goes on in a courtroom. With the use of the ADAAA to gain accommodations, the whole atmosphere and legal case can be turned around for you.   Contrary to revealing a weakness, the filing for accommodations is protected by the ADAAA itself and HIPAA.  It is not revealed to the court, only that you now have A Certified ADA Advocate by your side at all times. monitoring your physical and mental state, able  to request a short break.  Shielding you from the penetrating eyes of the monster and his gang.  Accommodations, with or without representation, are in place to safeguard a disabled person as would any hearing device, seeing device, or ramp would do for others.  Taking advantage of the ADAAA provides protection against bias, puts an umbrella of protection over legal proceedings prohibiting bullying and exploitation of the victim, and monitors conditions ensuring that the victim has equal access and opportunity to function to defend and protect themselves in the courtroom. </span></p>

<p>The legal system and its inherent complexities often present a huge challenge to litigants. There are many instances where an individual looking for legal resolution to a conflict faces immense stress during the judiciary process, and consequently ends up with psychological injuries. As a result, the individual is unable to complete the legal process and stay committed to it until the issue is resolved. In effect, the judicial system fails this individual and, in fact, causes more harm than good because of the psychological damage that is wrought to them.</p>
<p>For those litigants who are already suffering from hidden disabilities like these, traversing the legal arena and emerging successful can be a near impossible achievement. Owing to this, these litigants may simply avoid legal remedy even if they have a serious conflict that can be resolved effectively through a court process. 										<content:encoded><![CDATA[<h2>Passionate counselor seeks to help victims of the court system</h2>
<p>Denver, Colo.- October is Domestic Violence Awareness Month. Domestic<br />
violence is one of many issues that can be dealt with unjustly by the court system.<br />
Karin Huffer has made it her mission to help these victims skillfully stay in the<br />
fight.</p>
<p>Through her discussion of law, therapy and research, Huffer reveals a subtype of<br />
post-traumatic stress disorder called legal abuse syndrome, a condition in which<br />
one suffers psychological devastation caused by prolonged injustice. In her book,<br />
“Legal Abuse Syndrome,” Huffer provides an enlightening self-help guide to<br />
those who have suffered cumulative trauma.</p>
<p>“The book gets right to the issue of explaining what’s going on within the<br />
individual trapped in the judicial system, and offers up strategies for renewal of<br />
perspective with eight counseling recommendations,” Huffer said.</p>
<p>Through facts, graphics and heart rendering vignettes, readers grasp elements of<br />
this psychic injury, recognize its causes and benefit from the therapeutic tips<br />
provided. Drawing from her extensive background in marriage and family<br />
counseling, Huffer offers insight on subjects such as divorce, custody, child<br />
protection, domestic violence, corruption and many other societal issues.</p>
<p>Huffer’s hope is that her book will strengthen the confidence and resilience of the<br />
reader, and positively impact the court system by strengthening litigants.</p>

One of the legal fantasies promoted by governments and officials is the idea of ‘sovereign immunity’… where they are not liable for their corrupt and illegal actions.<br />
Unfortunately this lie of ‘sovereign immunity’ is also repeated unknowingly by people who have a real case against government officials and therefore do not pursue very valid claims.</p>
<p>A recent US Supreme Court decision clarified and confirmed that the government and their agents can be held liable and accountable for wrongdoing carried out by officials in its employment while on the job.</p>
<p>This should be a no brainer but in the land of legal fictions and unaccountable government officials being protected by legal process…someone FINALLY took the issue to the US Supreme Court for a common sense confirmation which lower level courts are now bound by.</p>
<p>This is a fundamental principle of law that nobody is above the law including all government actors.</p>
<p>The government immunity clause only applies to government actors when they are performing their actions of their office defined by their office in good faith.</p>
<p>Any actions that they take not defined by their office or illegal by their nature are considered have been done outside of their office therefore done in their private capacity and therefore they are fully liable in their private capacity without any protections of their office.</p>
<p>So in effect the government is also liable for having employed them, their supervisors are liable for improper training and oversight and the actions carried out while they were employee and the individual is liable personally also.</p>
<p>In this particular case the complaint and Millbrook had been denied hearings for his claims that the lower courts and submitted a hand written, in pencil, complaint to the Supreme Court of the United States. Less than 1% of Supreme Court applications are heard by the court. I’m certain that this particular case was heard because it addresses a fundamental aspect of law and the only point of protection for a private person from the abuses of any government actor.</p>
<p>If you take the time to read the articles about the case you’ll find the disgusting actions of government lawyers and lower courts protecting the corrupt and abusive actions of government actors creating a series of faulty case law decisions that perpetuate the idea that violence and criminal actions by government actors is protected.</p>
<p>Millbrook filed a handwritten petition, in pencil no less, to the U.S. Supreme Court, and in a rare show of magnanimity, the Court agreed to hear his case and assigned a lawyer to represent him. Curiously enough, after the Court announced it could hear the case, the U.S. Justice Department—which had defended the government’s actions at every level of the judicial proceedings, including asking the Supreme Court not to take the case—did an about-face and switched its position to argue that the FTCA does apply to prison guards as law-enforcement officials.</p>
<p>Sadly much “case law” is biased garbage designed to allow corruption to continue as most people do not have the time, stamina or money to challenge bad decisions to higher and higher courts where the real law might be heard and decided.</p>
<p>This case ultimately should be a watershed decision to open the doors for all manner of complaints against abusive and corrupt actions by government actors, the legal profession and officials as it now clearly confirmed by the Supreme Court that they do not have protection for their illegal and unlawful actions.</p>
